an Indian Citizen and I
live there. I have a
small ISP company and I
would like to set up US
company so I will be
able to accept credit
cards from US customers.
I heard that a Delaware
company (Delaware LLC)
is the best option. Is
this correct? if so, how

You are
correct
that a
Delaware
LLC (as
appose
to
Delaware
Corporation)
is an
excellent
choice
for you.
The
reason
for that
is that:
1.
anyone
can be
an owner
of a
Delaware
LLC
(including
Indian
Citizen)
2.
Delaware
LLC does
not pay
any US
tax,
only the
owners
of the
LLC pay
tax and
ONLY on
income
generated
in the
U.S.,
meaning
if your
LLC
income
is
generated
in India
you will
not be
subject
to US
tax.
In
terms of
Merchant
account,
yes, LLC
is
eligible
for US
merchant
account,
but
there
are
various
criteria
each
Merchant
Account
provider
apply to
determine
if your
US
entity
will get
approved.
These
criteria
are:
expected
volume,
average
transaction,
type of
activity,
company
history
and
owner
history,
previous
relationships
with
foreign
banks
and
ownership
US
social
security
.
